บทคัดย่อ

การวิจัยนี้ มีวัตถุประสงค์เพื่อ 1) ศึกษามาตรการกฎหมายลิขสิทธิ์ตามกรอบพันธกรณีความตกลงทริปส์ 2) ศึกษากฎหมายลิขสิทธิ์ในการคุ้มครองปัญญาประดิษฐ์และผลงานที่เกิดจากปัญญาประดิษฐ์ของประเทศเอเชียตะวันออก และ 3) ศึกษารูปแบบกฎหมายลิขสิทธิ์ที่เหมาะสมกับประเทศไทย เป็นการวิจัยเชิงคุณภาพโดยรวบรวมข้อมูลจากหนังสือ บทความ วิทยานิพนธ์ รายงานการวิจัย และเอกสารที่เกี่ยวข้อง
ผลการวิจัยพบว่า 1) ความตกลงทริปส์กำหนดมาตรฐานขั้นต่ำในการคุ้มครองลิขสิทธิ์ โดยคุ้มครองผู้สร้างสรรค์ควบคู่กับประโยชน์สาธารณะ และเปิดให้รัฐภาคีกำหนดกฎหมายและการตีความตามนโยบายของตนภายในกรอบดังกล่าว 2) ประเทศเอเชียตะวันออกใช้กฎหมายลิขสิทธิ์สนับสนุนการพัฒนา AI โดยคุ้มครอง AI เป็นโปรแกรมคอมพิวเตอร์ ส่วนผลงานจาก AI คุ้มครองแตกต่างกันตามบทบาทของมนุษย์ และ 3) กำหนดให้ผู้ใช้ ผู้พัฒนา หรือผู้จัดเตรียมระบบเป็นผู้ทรงสิทธิ พร้อมกำหนดสิทธิทางเศรษฐกิจ สิทธิทางศีลธรรม และข้อยกเว้น เพื่อรักษาสมดุลระหว่างการคุ้มครองและนวัตกรรม จากการวิเคราะห์เปรียบเทียบเชิงกฎหมาย งานวิจัยเสนอว่า ควรคงพระราชบัญญัติลิขสิทธิ์ พ.ศ. 2537 เป็นกฎหมายเฉพาะภายใต้ความตกลงทริปส์ และปรับให้รองรับ AI โดยกำหนดให้ผู้ใช้เป็นผู้ทรงลิขสิทธิ์เมื่อมีความคิดริเริ่มเพียงพอ กำหนดสิทธิในลักษณะสิทธิข้างเคียง ส่งเสริมการคุ้มครองแบบสหสิทธิ ขยายข้อยกเว้นเพื่อการพัฒนา AI และพัฒนากลไกเยียวยาทางปกครอง เพื่อรักษาดุลยภาพระหว่างสิทธิ นวัตกรรม และประโยชน์สาธารณะ

Abstract

This research aims to 1) study copyright legal measures within the framework of the TRIPS Agreement, 2) study copyright laws protecting artificial intelligence and works derived from artificial intelligence in East Asian countries, and 3) study the appropriate copyright law model for Thailand. This is a qualitative research study collecting data from books, articles, theses, research reports, and related documents. The research findings indicate that 1) the TRIPS Agreement sets minimum standards for copyright protection, protecting creators alongside the public interest, and allowing signatory states to establish their own laws and interpretations within this framework; 2) East Asian countries use copyright law to support AI development, protecting AI as computer programs, while protection for works derived from AI varies depending on the human role; and 3) it designates users, developers, or system providers as rights holders, defining economic rights, moral rights, and exceptions to maintain a balance between protection and innovation. Based on a comparative legal analysis, the research suggests that the Copyright Act of 1994 should remain a specific law under the TRIPS Agreement and be adapted to accommodate AI by designating users as copyright holders when sufficient original idea is developed, defining related rights, promoting mutual rights protection, expanding exceptions for AI development, and developing administrative remedies to maintain a balance between rights, innovation, and the public interest.
