บทคัดย่อ
งานวิจัยนี้มีวัตถุประสงค์ 1) เพื่อศึกษาบทบาท หน้าที่ และพันธกิจของศาลยุติธรรมที่เกี่ยวข้องกับคดีความมั่นคงในพื้นที่จังหวัดชายแดนภาคใต้ 2) เพื่อศึกษาปัญหาและอุปสรรคในการพัฒนาประสิทธิภาพการจัดการคดีความมั่นคงของสำนักงานศาลยุติธรรมในพื้นที่จังหวัดชายแดนภาคใต้ และ 3) เพื่อเสนอแนวทางการจัดการคดีความมั่นคงของศาลยุติธรรมในพื้นที่จังหวัดชายแดนภาคใต้ กลุ่มตัวอย่างที่ใช้ในการวิจัยคือ ผู้บริหารศาลฎีกา ผู้พิพากษาศาลฎีกา ผู้บริหารศาลอุทธรณ์ ผู้บริหารศาลอุทธรณ์ภาค 9 ผู้บริหารสำนักงานศาลยุติธรรม ผู้บริหารศาลชั้นต้น ผู้พิพากษาศาลชั้นต้นในพื้นที่จังหวัดชายแดนภาคใต้ ผู้บริหารสำนักงานอัยการ ทหาร ตำรวจ ผู้เชี่ยวชาญด้านคดีการก่อการร้าย ทนายความ นักวิชาการ และผู้ที่มีส่วนได้เสียโดยตรงอื่นๆ โดยใช้การเลือกจากหลักเกณฑ์ว่าเป็นผู้มีประสบการณ์ตรงเฉพาะด้าน ผู้เคยปฏิบัติงานจังหวัดชายแดนภาคใต้ และเป็นผู้ที่เคยรับผิดชอบงานด้านความมั่นคง เก็บข้อมูลด้วยการสัมภาษณ์เชิงลึกและสนทนากลุ่ม ดำเนินการต่อด้วยเทคนิค การวิเคราะห์เนื้อหา
โดยข้อสรุปที่ได้จากผลการวิจัย มีดังต่อไปนี้ การจัดการคดีความมั่นคงของสำนักงานศาลยุติธรรมในพื้นที่จังหวัดชายแดนภาคใต้ ควรปรับใช้กรอบแนวคิดทางการจัดการภาครัฐที่เรียกว่า “การจัดการปกครองสาธารณะแนวใหม่” (NPG) ในการดำเนินงานเพื่อให้สามารถตอบรับต่อความเปลี่ยนแปลงในบริบทการจัดการสาธารณะในยุคปัจจุบันที่ต้องแก้ไขปัญหาและวิกฤติต่างๆ โดยอาศัยเครือข่ายความร่วมมือจากทุกภาคส่วนสังคมตามพันธกิจของศาลยุติธรรมจะต้องปรับปรุงคุณภาพกระบวนการยุติธรรมให้มีสมรรถนะเท่าทันกับความซับซ้อนของสังคมโลกตลอดจน ปรับเปลี่ยนกระบวนการทำงานที่มีประสิทธิภาพในการทำหน้าที่คุ้มครองสิทธิเสรีภาพของประชาชน นำหลักธรรมาภิบาลมาปรับใช้ในการปฏิบัติงานของบุคลากรให้มีหลักนิติธรรม หลักคุณธรรม หลักความโปร่งใส หลักความมีส่วนร่วม หลักความรับผิดชอบ หลักความคุ้มค่าในการบริหารจัดการ และการใช้ทรัพยากรที่มีจำกัดเพื่อให้เกิดประโยชน์สูงสุดแก่ส่วนรวม ตลอดจนการนำแนวคิดสมานฉันท์มาปรับใช้ มุ่งเน้นให้มนุษย์อยู่ร่วมกับสรรพสิ่งอย่างปกติสุขในการสร้างสันติสุขและความมั่นคงของพื้นที่จังหวัดชายแดนใต้

Abstract
The objectives of this research were: 1) to study the role and missions of Thai Court of Justice that related to the security cases in southern border provinces 2) to study problems and obstacles in improving the efficiency of the court’s security case management in southern border provinces and 3) to provide the guideline to administer the security cases of the Thai Court of Justice in the southern border provinces. The samples of the study include supreme court executives and administrators, supreme court judges, court of appeal (region 9) administrators, court of justice administrators, civil court administrators, civil court judge who stationed in the Thai southern border provinces, public prosecutors, military officers, police officers, specialists of terrorism cases, attorney, academicians and other related stakeholders. All key informants were selected by their direct experiences from career and responsibility toward the security missions in the southern border provinces of Thailand. The research techniques include in-depth interviews, focus group session and content analysis.
The conclusions based on the result of study were to manage the security cases of the court of justice in southern border provinces of Thailand under the framework of the New Public Governance (NPG) in order to cope with changes in the current public management context where cooperative networks from all the social sectors are required to solve problem and to alleviate crises. In accordance with the judiciary’s mission, the quality of judicial procedures must be improved to meet the complexity of global society. The efficiency in protecting people’ human rights and freedom are required as well as the adaptation of good governance principle including the rules of law, merit system, transparency, participation, accountability and the economy of management and the maximization of resource utilization for public values. Lastly, the reconciliation concept is needed for ensuring the harmony of coexistence living, all enable peace building and security in the southern border provinces of Thailand.
