Abstract
The objectives of this research were: 1) to study concepts and theories of caste system and human rights; and 2) to analyze caste system existence in contemporary world and the possibility to dismantle caste system. This research applied qualitative research by using documentary research methods. The secondary data were collected from various documents, including academic books, research reports and papers, review articles and newspapers, official reports of governments and international organizations. The data were used to analyze the conceptual contradiction between the Indian caste system and the doctrine of human rights, including their philosophical foundations, socio-legal impacts, and their lived experiences of caste-based discrimination. The study further explored the intersectionality of caste with gender, economic class, and political exclusion to evaluate the structural challenges in achieving substantive equality. The data analysis was conducted by using content analysis, logical analysis, and comparative analysis, in order to make the research’s conclusion, discussion and recommendations.
This research found that the Indian caste system had impacts on individual rights and universal human rights as a whole. The research demonstrates how caste system, which is based on religious, social, and economic hierarchies, profoundly contradicts the equality, dignity, and non-discrimination values inherent in international human rights law. Moreover, the rigid caste system violates fundamental individual rights of Dalit women and also discriminates gender equality and social justice of untouchable persons. The research shows that the caste-based exclusion continues to pose a serious threat to social fairness and democratic principles through compared case studies and legal frameworks.
